Section one (1) of the 1999 Constitution of the Federal Republic of Nigeria, provided for the supremacy of the Constitution which does not exclude Chapter II. To further strengthen this provision, section 13 of the Constitution, provided that, it shall be the duty and responsibility of all organs of government ... to confirm, to observe and apply the provision of this chapter of this constitution. The entire Chapter II of the Constitution of the Federal Republic of Nigeria (CFRN), 1999 is devoted to political, economic, social, cultural and developmental rights of the citizens. However, this chapter is non-justiciable by virtue of section 6(6)c of the same constitution. Examining the implications of such non-justiciability showed that citizens cannot obtain redress from the courtof law if denied their socio-economic, developmental and other rights provided for in this chapter. It is therefore an impediment to socio-economic development.It is on thisnote this study critiquedthe impact of chaptertwo of the 1999 constitution on good governance in Nigeria. The study also examined  provisions of socio-economic rights (ESCR) in Irish Republic, India and South Africa constitutions to ascertain the attitude of courts to their interpretations and applications. The study found that non-justicialbility of chapter II of the 1999 CFRN, is an obstacle to development, accountable government and good governance. The study therefore recommends that chapter II  of the constitution be made justicialble by amending sections 6(6)c and 308 amongst others.
