Abstract

This position paper discusses the division of Nigerian Criminal Justice System which commences with an arrest, arraignment, trial; processes which lead to sentencing by the court may lead to imprisonment with or without option of fine or acquittal. The article defines sentencing as a concept, discusses the principles behind sentencing, lists  the rules governing sentencing, and it goes further to discuss the forms or types of sentencing which are death, fine, caning or whipping, forfeiture and others. It also explains crime and its environmental impact before finally concludes and makes some recommendations which includes taking into account the Nigerian prison conditions, institution of restorative justice, getting more information about offenders, teaching of phenology in our schools among others.
